Vermilion County State’s Attorney Jacqueline Lacy says no charges will be filed in the shooting death of an inmate at the county courthouse on August 23rd (2019). Lacy has received the Illinois State Police investigative file regarding the officer involved shooting of Daryl Perkins.
‘’I have reviewed all the police reports, witness statements, courthouse security video, 911 recordings, autopsy report, as well as all photographs of the scene and autopsy,’’ said State’s Attorney Lacy. ‘’After a review of all materials provided, and in discussions with the Illinois State Police investigator assigned to the investigation, I have concluded that no criminal charges are warranted in this matter,’’ said Lacy in a news release late Friday.
Lacy says the review of the case found that Perkins had attacked Deputy Kyle Janesky with several Bic pens when the deputy opened the door of a restroom in the holding area of the courthouse. Perkins continued to fight Janesky and attempted to reach the officers firearm or taser.
Janesky continued to protect his firearm and taser while Perkins (the inmate) had his knee holding the officer down with his full weight on the deputy’s neck. The men then got into a semi-standing position as they continued to wrestle. Perkins was able to remove Janesky’s taser and aimed it at the deputy. It was at that point that the deputy pulled his service weapon and fired at Perkins.
Other deputies, members of courthouse security, and Danville Police Officers arrived within moments in when the shots were fired and secured the scene. Perkins was transported to OSF Sacred Heart Medical Center where he was pronounced dead. Officer Janesky was also taken to the hospital and was treated for stab wounds to the eye, face and neck. The Deputy also suffered defensive wounds to his hands.
State’s Attorney Lacy says the autopsy found that Perkins died from multiple gunshot wounds. He was shot in the right and left chest, mid abdomen and right hand. All the gunshot wound trajectories were from the front.
‘’Based on the totality of the circumstances, deadly force was justified,’’ concluded the State’s Attorney. She says the entire encounter was captured on security video showing that as soon as Perkins was let out of the bathroom he began to attack Deputy Janesky.
