Judge Issues Cell Phone Ban for all Future Sessions on this Case
The bail for 45 year old Anthony Austin of Georgetown has been increased from “10% posted of $50,000” to “10% posted of $150,000” by Judge Charles C. Hall.
Austin faces two counts Aggravated DUI Resulting in the Deaths of Two or More People after an accident last fall that killed a mother, father, and daughter from Oxford, Indiana. Fifty-two year old Lee Hall, 46 year old Felisha Hall, and 18 year old Madison Hall lost their lives when their northbound Silverado was struck by a southbound GMC Sierra that had drifted into the northbound lane at Catlin-Indianola Road and County Road 550 in Indianola.
Vermilion County State’s Attorney Jacqueline Lacy argued before Judge Hall on Wednesday (May 3rd) afternoon that the bond change was needed because Austin’s physical condition had changed. Lacy stated that after being seriously injured in the accident, Austin was unfit for jail and a very low flight risk being in a wheelchair. Lacy said that although Austin’s shoulder is now in a sling, he is able to walk, feeling better; and therefore a much greater flight risk.
The defense pointed out that Austin is still undergoing physical therapy for his recent shoulder operation, and that he has an exploratory procedure coming up; and therefore should be allowed to remain at home while wearing an electronic monitoring system. Judge Hall said that as long as Austin is able to be released for his procedure, he should be able to receive all follow-up care while in jail. The judge concluded that until he is shown that Austin cannot receive the care while behind bars, should he not post bail, then the increase will be granted. Judge Hall also told Austin that should he post the 10 percent, then all previous requirements, such as wearing the ankle monitoring device, would apply.
After Austin was taken into custody and led out of the courtroom, Lacy asked for the case to be recalled and requested that Judge Hall warn the victims’ family and friends about cell phones needing to be off while in the courtroom. Judge Hall subsequently stated that all those attending future sessions on this case, including the press, will be required not to have cell phones upon entering the courtroom.
Anthony Austin’s next pre-trial date is Monday, June 5th; at 9 AM.
