ABOVE: A lawsuit has been filed against Goldwater Care skilled-nursing facility in Danville in a patient’s 2024 death.
DANVILLE — A wrongful-death lawsuit seeking more than $300,000 has been filed against skilled-nursing facility Goldwater Care in the death of a patient last year.
The civil suit was filed in April by the law firm of Dudley & Lake LLC of Chicago, which is representing the estate of the late patient, Marion Ballard.
The lawsuit states that Ballard “experienced an aspiration event which resulted in him coughing and choking on secretions while eating his lunch” on Sept. 19, 2024. It alleges Ballard’s aspiration was not adequately addressed and he experienced “significant pain and suffering” as he struggled to breathe and experienced respiratory distress.
The lawsuit continues that during this distress, nursing staff didn’t contact paramedics or other emergency services, and they were unable to timely locate suctioning equipment.
