DANVILLE — The United Food and Commercial Workers International Union this week won its lawsuit to compel meat-casing manufacturer Viscofan to follow an arbitrator’s decision regarding the unlawful termination of Tim Miller, a union leader at the company’s facility in Danville.
According to the union, Miller, who was terminated in 2023, won his case against the company for his wrongful termination, which granted him his job back with back pay. The company had refused to comply with the decision, forcing the union to sue in federal court to compel the award.
“Tim Miller, who was terminated for simply serving on his union’s executive board, has his job back, with back pay,” UFCW Local 700 President Tracy Bartak said in a statement on the victory. “Viscofan could have followed the arbitrator’s decision as required by law, but instead, they fought it tooth and nail, just as they’ve been fighting their unionized workers for years. This is a major victory for Tim and all Viscofan workers in Danville who have been subjected to their employer’s scorched-earth anti-union campaign.”
